Toud Marketing and Design’s commitment regarding the processing of personal data
The processing of personal data is carried out in your service, as a current or potential client. All actions taken by Toud Marketing and Design observe the right to private and family life, home and communications, the protection of personal data, freedom of thought, conscience and religion, freedom of expression and information, freedom to conduct a business, the right to an effective remedy and to a fair trial, as well as cultural, religious and linguistic diversity.
We undertake to build a secure environment for collecting and storing personal data. To this end, we provide SSL connections on all Toud Marketing and Design websites (listed above). In addition, data collected through forms is either stored in the CRM provided by HubSpot, in Mail Chimp, or deleted after a very short period of time, in accordance with our internal procedures. You can check at any time whether Toud Marketing and Design stores data about you, either by accessing your subscription directly in the Toud Marketing and Design Mail Chimp account (when you subscribed you received an email giving you access to your account) or by sending a request to inspire@toud.ro. We do our best to keep data up to date.
You should also know that our websites are operated and managed on servers located in the European Union.

Purpose and legal basis for processing data
- You filled in one of the forms on the website
We use forms on Toud Marketing and Design websites to make communication easier.
The forms are located on the contact pages and on the promotions pages.
All Toud Marketing and Design forms include a field where you can give your consent for the data to be stored by Toud Marketing and Design. If you do not give your consent, the data will not be stored.
The data is stored so that we can get back in touch with you at any time. The data is stored for a period of 5 years. After this period the data will be deleted.
- You subscribed to the newsletter
Your personal data will be used for the sole purpose of sending marketing communications about Toud Marketing and Design services, offers and/or promotions, news, upcoming campaigns, and invitations to various events organised by Toud Marketing and Design (or that we are involved in) during a given period.
Your personal data will be deleted when you unsubscribe from the newsletter.
You can unsubscribe at any time via the link included in the newsletter you receive, or by sending a written request to inspire@toud.ro.
- Comments on our websites (WordPress platform)
When visitors leave comments on our websites, we collect the data shown in the comment forms, as well as the visitor’s IP address and browser user agent string, to help us detect spam.
An anonymised string (also called a hash) created from your email address may be provided to the Gravatar service to see whether you use it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After your comment is approved, your profile picture is visible to the public next to your comment.
4. You visited one of our websites
To give you a good quality experience when you browse our websites, we use cookies. These fall into 3 categories:
- Necessary
- Traffic monitoring (integration with Google Analytics)
- Marketing (integration with Google Adwords and Facebook services) – allows the ads you see to be optimised.
You should also know that cookie files do not contain information that could lead to your direct identification. Cookie files may be generated by Toud Marketing and Design as well as by partner entities (Google, Facebook, etc.). Cookie files are stored for shorter periods of time. You always have the option of setting your web browser not to allow cookie files to be stored.
Additional information about cookies according to the WordPress platform (on which our websites are built).
If you leave a comment on our site, you may opt in to saving your name, email address and website in cookies. These are for your convenience, so that you do not have to fill them in again when you leave another comment. These cookies will last for one year.
If you have an account and you log in to this site, we will set a temporary cookie to determine whether your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
When you log in, we will also set several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login cookies will be kept for two weeks. If you log out of your account, the login cookies will be removed.
If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
If you leave a comment, the comment and its metadata are kept indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users who register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit or delete their personal information at any time (except that they cannot change their username). Website administrators can also see and edit that information.
For all 4 cases presented above, providing personal data is voluntary. Refusing to provide data for the purposes presented above will have no negative consequences for you.
Embedded content from other websites
Articles on this site may include embedded content (for example, videos, images, articles, etc.). Embedded content from other websites behaves in exactly the same way as if the visitor had visited the other website.
These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with the embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.
Your rights
You have full control over your data at all times. Below we have created a list of the rights you have in accordance with the provisions of the GDPR:
- Access to your personal data, as well as to the manner in which it is processed.
- Rectification or updating of data that is incorrect or no longer current.
- Erasure of data (the right to be forgotten).
- Restriction of processing – the processing of personal data may be restricted in a number of situations established by law.
- Objection to the processing of personal data.
- Portability of personal data, which can be obtained in a common format or transferred to another economic operator of your choice.
- Withdrawal of consent to the processing of personal data.
- The right to lodge a complaint with the competent authority if you notice any irregularities.
- The right to disable cookies – you can do this while browsing Toud Marketing and Design websites, by choosing No when you are asked for your consent to use cookies.
To exercise these rights, use one of our contact methods: write to us at inspire@toud.ro or call any of the telephone numbers listed in the contact section of the Toud Marketing and Design websites.
Disclosure of personal data to third parties
Personal data processed through the Toud Marketing and Design websites (listed above) may be disclosed and/or transferred to third parties only where you have given your express consent to proceed in this way, except in situations where Toud Marketing and Design has a legal/contractual obligation to proceed in this way.
Policy regarding minors
We do not intend to collect information from minors. We do not target minors as potential beneficiaries of the services offered by Toud Marketing and Design.

HUBSPOT
COOKIES
Cookies set in a visitor’s browser by HubSpot
The HubSpot tracking code sets a number of tracking cookies when a visitor lands on your website. These cookies fall into two general categories:
Essential / necessary cookies: essential cookies that do not require consent.
Consent-type cookies: cookies included in the GDPR consent banner.
Essential / necessary cookies
__hs_opt_out
This cookie is used by the opt-in privacy policy to remember not to ask the visitor to accept cookies again. This cookie is set when you give visitors the option to opt out of cookies.
(Expires: 13 months)
__hs_do_not_track
This cookie can be set to prevent the tracking code from sending any information to HubSpot. Setting this cookie is different from opting out of cookies, as it still allows anonymised information to be sent to HubSpot.
(Expires: 13 months)
hs_ab_test
This cookie is used to consistently serve visitors the same version of an A/B test page that they have seen previously.
(Expires: end of session)
_key
When you visit a password-protected page, this cookie is set so that future visits to the page from the same browser do not require authentication again. The cookie name is unique for each password-protected page.
hs-messages-is-open
This cookie is used to determine and save whether the chat widget is open for future visits. It resets to close the widget again after 30 minutes of inactivity.
(Expires: 30 minutes)
hs-messages-hide-welcome-message T
his cookie is used to prevent the welcome message from appearing again for one day after it has been dismissed.
(Expires: 1 day)
__hsmem
This cookie is set when visitors log in to a HubSpot-hosted site.
(Expires: 1 year)
Consent banner cookies
__hstc
The main cookie for tracking visitors. It contains the domain, utk, initial timestamp (first visit), last timestamp (last visit), current timestamp (this visit) and session number (which increments for each subsequent session).
(Expires: 13 months)
hubspotutk T
his cookie is used to keep track of a visitor’s identity. This cookie is passed to HubSpot on form submission and is used when deduplicating contacts.
(Expires: 13 months)
__hssc
This cookie keeps track of sessions. This is used to determine whether HubSpot should increment the session number and timestamps in the __hstc cookie. It contains the domain, viewCount (which increments with each page view in a session) and the session start timestamp.
(Expires: 30 min)
__hssrc
Whenever HubSpot changes the session cookie, this cookie is also set to determine whether the visitor has restarted their browser. If this cookie does not exist when HubSpot manages cookies, it is considered a new session.
(Expires: end of session)
messagesUtk
This cookie is used to recognise visitors who talk to you through the messages tool. If the visitor leaves your site before being added as a contact, they will have this cookie associated with their browser. If you chat with a visitor who later returns to your site in the same cookied browser, the messages tool will load their conversation history.
(Expires: 13 months)
Ad tracking
If you use the HubSpot ads tool to select and install your Facebook pixel on pages with the HubSpot tracking code, HubSpot will connect the placement of that pixel code with the cookie notification banner. If you require opt-in consent through this banner, the Facebook pixel will not be able to set cookies on a visitor until they have opted in.
If you have manually placed the pixel code on pages (for example, by editing the site’s HTML header), HubSpot will not be able to control which visitors Facebook is able to set cookies on.
For further information, see the Facebook business tools terms and the Facebook cookie consent guide.
Cookies from third-party systems
HubSpot cannot control cookies placed by third-party scripts on your website. When a visitor accepts cookies via the HubSpot consent banner, they are only accepting HubSpot cookies. However, you can put code in place to know when a user has accepted or declined HubSpot cookie tracking, and then send that information to your third-party system. Learn more about using the HubSpot consent banner for third-party scripts.
Other information
Learn about removing cookies created by the HubSpot tracking code that are included in the GDPR consent banner. When a visitor’s cookies are removed, the visitor will be considered “new” and will see the cookie banner the next time they visit your site.
Visitors who visited your website before the cookie policy banner was created will already have the cookies created by the HubSpot tracking code in their browser. They will therefore not see the cookie policy.
Personal data protection – HubSpot
To optimise your experience across the digital communication channels used by Toud Marketing and Design, we have implemented the CRM system provided by HUBSPOT. This system involves a series of activities, which we explain below:
1. Information we collect
By filling in the forms on the Toud Marketing and Design website you send us personal information. We ask for this information in order to learn more about you and to be able to provide the information you need more quickly and more easily. The information is kept in the HubSpot system (the information goes to the HubSpot cloud and is stored on HubSpot servers in the USA). The information we collect and manage using the HubSpot service belongs to us and is used, disclosed and protected in accordance with this Privacy Policy.
When you visit our websites
You are free to explore the Websites without providing personal information about yourself. When you visit the Websites or register for the subscription service, we ask you to provide personal information about yourself and we collect navigation information.
“Personal information”
This refers to any information you voluntarily submit to us that personally identifies you, including contact information such as your name, email address, company name, address, telephone number and other information about you or your business. Personal information may also include information about you that is available on the internet, such as from Facebook, LinkedIn, Twitter and Google.
Personal information includes navigation information. Navigation information refers to information about your computer and your visits to websites, such as your IP address, geographic location, browser type, referral source, length of visit and pages viewed. See the “Use of navigation information” section below.
Log files

This information may include your IP address, browser type, domain name, internet service provider (ISP), files viewed on our site (for example, HTML pages, graphics, etc.), operating system, clickstream data, access times and referring website addresses. This information is used by HubSpot to provide general statistics regarding the use of the websites. For these purposes, we link this automatically collected data to Personal information such as name, email address, address and telephone number.
Information we collect from third parties
From time to time, we may receive personal information about you from third-party sources, including partners with whom we offer co-branded services or engage in joint marketing activities, and publicly available sources such as social media sites.
2. How we use the information we collect
Compliance with our Privacy Policy
We use the information we collect only in accordance with this Privacy Policy. Clients who fill in our forms are bound by our agreements with them to comply with this Privacy Policy.
We never sell personal information
We will never sell your Personal information to third parties.
Use of personal information
In addition to the uses identified in the previous chapters of this Privacy Policy, we may use your personal information to:

promote our services and products and share promotional and informational content in accordance with your communication preferences;
provide other companies with statistical information about our users – but this information will not be used to identify any user;
send you information about changes to the Terms and customer services, the Privacy Policy (including the Cookie Policy) or other legal agreements.
Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, we will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and is not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you.
If we ask you to provide personal information in order to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and will advise you whether providing your personal information is mandatory or not (as well as the possible consequences if you do not provide your personal information). Similarly, if we collect and use your personal information relying on our legitimate interests (or those of any third party), we will make clear at the relevant time what those legitimate interests are.
Use of navigation information
We use Navigation information so that we can deliver the best content to you and continuously improve the websites. We may also use Navigation information alone or in combination with Personal information to provide you with personalised information about Toud Marketing and Design.
Customer testimonials and comments
We post customer testimonials and comments, which may contain personal information, on our websites. We obtain each customer’s consent by email before posting their name and testimonial.
Security of your personal information
We use a variety of security technologies and procedures to protect your personal information against unauthorised access, use or disclosure. We secure the Personal information you provide on computer servers in a controlled, secure environment, protected from unauthorised access, use or disclosure. All personal information is protected using appropriate physical, technical and organisational measures. All these solutions are provided by HubSpot. For more information about HubSpot security, see https://www.hubspot.com/security.
Social media features

External websites
Our Websites provide links to other websites. We do not control and are not responsible for the content or practices of these other websites. Providing such links does not constitute our endorsement of these other websites, their content, their owners or their practices. This privacy policy does not apply to these other websites, which are subject to any privacy policy and other policies they may have.
Public forums
We provide areas on the site where you can leave publicly accessible messages. Please note that if you disclose information directly through these public areas, the information may be collected and used by other users. We will correct or delete any information you have posted on the websites if you request it, as described in “Opting out and unsubscribing” below.
Retention of personal information
How long we keep the information we collect about you depends on the type of information, as described in detail below. After such time, we will delete or anonymise your information or, if this is not possible, we will securely store your information and isolate it from any other use until deletion is possible.
When there is no longer a need to process your personal information, we securely delete the information or anonymise it or, if this is not possible, we securely store your personal information and isolate it from any further processing until deletion is possible. We will delete this information at an earlier date if you request it, as described in “How to access and control your personal data” below.
If you have chosen to receive marketing communications from us, we keep information about your marketing preferences for a reasonable period of time from the date you expressed interest in our content, products or services, such as when you last opened an email from us or stopped using your HubSpot account. We keep information derived from cookies and other tracking technologies for a reasonable period of time from the date this information was created.
3. How we share the information we collect
Service providers
We employ other companies and individuals to provide services to visitors of our websites, and we may need to share your information with them in order to provide you with information, products or services. Examples may include removing repeated information from prospect lists, analysing data or performing statistical analysis, providing marketing assistance, supplementing the information you provide to us so that we can offer you a better service, and providing customer service or support. In all cases where we share your information with such agents, we explicitly require the agent to acknowledge and comply with our privacy and customer data management policies. These processes do not involve transferring the information to these entities, only facilitating access to this data in the most secure way.
4. International transfer of information
International transfers within HubSpot entities
The information collected by HubSpot is stored and processed in Ireland and the USA.
This privacy policy will apply even if we transfer personal information to other countries. HubSpot has taken appropriate safeguards to require that your personal information remains protected. HubSpot holds standard contractual data protection clauses that have been approved by the European Commission and relies on the bilateral agreements on the protection of personal data – the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks.
Privacy Shield notice
HubSpot participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. The following affiliated entities comply with the Privacy Shield principles: HubSpot Ireland Limited, HubSpot Germany GmbH, HubSpot France S.A.S, HubSpot Australia Pty Ltd, HubSpot Asia Pte. Ltd., HubSpot Latin America S.A.S and HubSpot Japan KK. HubSpot publicly commits to subject all personal data received from European Union (EU) member countries and Switzerland, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles. To learn more about the Privacy Shield Framework, visit the U.S. Department of Commerce’s Privacy Shield List at https://www.privacyshield.gov.
5. Cookies and similar technologies
Toud Marketing and Design, through HubSpot technologies, uses cookies or similar technologies (such as web beacons) to analyse trends, administer the website, track users’ movements around the website and gather demographic information about our user base as a whole. To learn more about how we use cookies on our website and how to manage your cookie preferences, see our Cookie Policy.
What types of cookies do we use and how do we use them?
The specific types of first- and third-party cookies served through our Websites and the purposes they perform.
Essential website cookies: These cookies are strictly necessary to provide you with services available through our website.
Performance and functionality cookies: these cookies are used to improve the performance and functionality of the website, but are not essential to its use. However, without these cookies, certain functionality may become unavailable.
Analytics and personalisation cookies: These cookies collect information that is used either in aggregate form to help us understand how our website is used, how effective our marketing campaigns are, or to help us customise our website for you.
Advertising cookies: these cookies are used to make advertising messages more relevant to you. They perform functions such as preventing the same ad from continuously reappearing, ensuring that ads are displayed correctly for advertisers and, in some cases, selecting advertisements that are based on your interests.
Social networking cookies: these cookies are used to enable you to share pages and content that you find interesting on our website through third-party social networks and other websites. These cookies may also be used for advertising purposes.
What about other tracking technologies, such as web beacons?
Cookies are not the only way to recognise or track visitors to a website. We use a software technology called clear gifs (for example, Web Beacons / Web Bugs), which helps us manage the Website better by telling us what content is effective. Clear gifs are tiny images with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. Unlike cookies, which are stored on the user’s computer hard drive, clear gifs are embedded invisibly on Web pages or in emails and are about the size of the full stop at the end of this sentence. We use clear gifs or pixels in our HTML-based emails to tell us which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. We link the information collected by clear gifs in emails to our customers’ personal information.
